5.6. Penalties for Non-compliance for Directors of an Association

In NSW, The Associations Incorporation Act 2009 provides that an authorised officer may issue a penalty notice on a person if it appears to the officer that the person has committed a penalty notice offence under the Act (section 93).

The offences for which a penalty notice may be issued and the amount of the penalty are prescribed in Schedule 4 of the Associations Incorporation Regulation 2016. The amount of the penalty ranges from $50-$200. [1]
